Our Top 3 Trademark Selection Tips!

We know you’re here to learn some trademark tips, so we’ll get straight into it!

1. Choose a mark that stands out.

The further right your trademark falls on the above image (i.e., the trademark spectrum of distinctiveness), the stronger protection you will have.

Choosing a mark that stands out from your competitors is of the utmost importance! You want customers to remember YOU. To buy from YOU. So choose a trademark that is unique, or as unique as possible, while still reminding your customers why they should buy your specific product or service.

2. Choose a mark that appeals to your customer

Remember good branding techniques. You want something that appeals to you of course, but keep your customer in mind as well!

This example may sound silly, but if you are selling fresh apples to a customer, it would likely not be too appetizing if your fresh apples were being sold under the name “Horse Poop”. While, it’s arguably a strong arbitrary mark for your product, it likely does not appeal to customers to buy apples under the “Horse Poop” brand.

3. Know the meaning of your mark in all places you sell

Remember to apply a little common sense. Know what your image means or word(s) translates to or means everywhere you sell. 

Even simple hand signs like the thumbs up sign above can have different meanings and could be considered offensive in other places around the world.

Remember to not choose words/images that would offend your customers or are just generally in bad taste to use. Know what your trademark means in all the locations you plan on using the mark. For example, a word might mean one thing in the USA, but it might mean something else entirely in another country.
