Choosing a mark that stands out from your competitors is of the utmost importance! You want customers to remember YOU. To buy from YOU. So choose a trademark that is unique, or as unique as possible, while still reminding your customers why they should buy your specific product or service.

This example may sound silly, but if you are selling fresh apples to a customer, it would likely not be too appetizing if your fresh apples were being sold under the name “Horse Poop”. While, it’s arguably a strong arbitrary mark for your product, it likely does not appeal to customers to buy apples under the “Horse Poop” brand.

Remember to not choose words/images that would offend your customers or are just generally in bad taste to use. Know what your trademark means in all the locations you plan on using the mark. For example, a word might mean one thing in the USA, but it might mean something else entirely in another country.
